Last Updated: August 31, 2026
FKN Performance, doing business as Frosty's Dyno Tuning ("Company," "we," "us," or "our"), respects your privacy. This Privacy Policy explains how we collect, use, disclose, and retain information through https://frostysdyno.com and related communications that begin through the Website (collectively, the "Website"). It also explains choices and rights that may be available to you.
This Privacy Policy is a notice of our practices. It is not intended to obtain consent where applicable law requires consent to be obtained separately.
1. Information We Collect
The information we collect depends on how you use the Website and which features are enabled.
Information You Provide
We may collect information you voluntarily provide, such as:
- name;
- email address;
- telephone number;
- mailing or service address, when relevant;
- information in contact, appointment, quote, estimate, or service-request forms;
- communications you send to us;
- accessibility feedback and related diagnostic information; and
- other information you choose to provide.
Please do not submit Social Security numbers, full payment-card details, account passwords, medical information, or other highly sensitive information through a general Website form unless we specifically request it through an appropriate secure process.
Information Collected Automatically
When you use the Website, we and our service providers may automatically receive information such as:
- IP address;
- browser, device type, and operating system;
- referring page and pages visited;
- date and time of access;
- general location derived from an IP address;
- interactions with Website pages and features;
- security, performance, and diagnostic information; and
- cookie, advertising, or similar identifiers where applicable.
Some of this information may be recorded in hosting, content-delivery, security, analytics, form-processing, or server logs.
Accessibility Feedback Diagnostics
If you submit the accessibility feedback form, the form automatically records limited technical details intended to help us reproduce and address the issue. These may include the page address, submission time, browser and operating-system information derived from the user-agent string or similar browser information, viewport or screen dimensions, language, and time zone. We do not ask you to type your browser or operating system. We do not use accessibility submissions or their diagnostic information for unrelated marketing, advertising, retargeting, or audience-building.
Information From Other Sources
We may receive information from service providers that help us operate the Website, communicate with customers, prevent fraud, measure advertising, or provide requested services. We may also receive information from advertising or referral partners when applicable. Information received from another source may be combined with information we collect, consistent with this Policy and applicable law.
2. How We Use Information
We may use information to:
- respond to questions, requests, and accessibility reports;
- provide estimates, appointments, communications, or requested services;
- operate, maintain, personalize, and improve the Website and our services;
- understand Website usage and performance;
- measure marketing and advertising performance where applicable;
- provide or measure advertising where applicable;
- protect the Website, our business, and users; detect fraud, abuse, and security incidents; and troubleshoot problems;
- maintain business, transaction, security, and compliance records;
- establish, exercise, or defend legal rights;
- comply with law and lawful process; and
- carry out another purpose disclosed when information is collected or with your direction.
An accessibility submission will be used to investigate, respond to, and remediate the reported accessibility issue, provide an accessible alternative when reasonably possible, maintain appropriate records, and protect the form from abuse. It will not be used to enroll you in marketing or to create an advertising audience.
3. Cookies and Similar Technologies
The Website may use cookies, local storage, pixels, tags, software development tools, and similar technologies for functions such as security, preferences, analytics, and advertising. Some technologies are set by us, and others are set by service providers.
The production Website currently uses the following relevant services and technologies:
- Cloudflare (hosting, content delivery, and security) — serves and protects the Website and records security, performance, and diagnostic information
- Google Maps (embedded location map) — shows the business location and gives visitors access to directions
- Cloudflare Turnstile (form abuse protection) — verifies that a form submission is not automated
- Postmark (transactional email delivery) — delivers form submissions to the business
- Google Analytics 4 (website traffic and usage analytics) — measures how visitors find and use the Website so the business can improve it
- Cloudflare Web Analytics (aggregate traffic and page-performance measurement) — shows the business aggregate traffic and page-speed data for the Website
Cloudflare Web Analytics is added to every page by our hosting network rather than by the Website itself, and not covered by the Privacy Choices control on the Website, which cannot switch it off. It is limited to aggregate page and performance measurement: it sets no cookie, stores nothing in your browser, and does not identify you or follow you to other websites. A content blocker or a browser setting that blocks scripts prevents it.
This list is intended to reflect services actually active on the Website. A service may change the specific cookies or identifiers it uses. Third-party services process information under their own terms and privacy notices.
You can control some cookies through your browser. Blocking cookies may affect Website features. You may also use the Privacy Choices link on the Website to manage the categories shown there.
4. How We Disclose Information
We may disclose information to vendors and service providers that perform work for us, such as:
- Website hosting, content delivery, security, and maintenance;
- form processing, file storage, email delivery, and customer communications;
- scheduling, customer relationship management, and call handling;
- analytics, advertising, and marketing measurement where applicable;
- payment processing where applicable; and
- professional advisers and other operational support.
These recipients may use information to provide services to us and as otherwise permitted by their agreements and applicable law.
We may also disclose information:
- when required by law, subpoena, court order, or other valid legal process;
- when reasonably necessary to protect the rights, safety, property, or security of the Company, our customers, or others;
- to investigate fraud, abuse, or security incidents;
- in connection with a merger, acquisition, financing, restructuring, bankruptcy, sale, or transfer of all or part of a business; or
- with your direction or consent.
5. Sale, Sharing, and Targeted Advertising
We do not sell personal information for money. Based on the practices described in this Policy, we also do not sell or share personal information for cross-context behavioral advertising, or process it for targeted advertising, as those terms are defined by privacy laws that apply to us.
6. Browser-Based Privacy Signals
Where required by applicable law, we process a recognized user-enabled universal opt-out preference signal, such as Global Privacy Control (GPC), as a request to opt out of applicable sales, sharing, or targeted advertising for the browser or device sending the signal. Information about how these signals are processed is available through Privacy Choices.
7. Your Privacy Rights and Choices
Depending on where you live, the information involved, and whether a particular law applies to us, you may have rights to:
- request access to or information about certain personal information;
- request correction of inaccurate personal information;
- request deletion of certain personal information;
- obtain a portable copy of certain personal information;
- opt out of certain sales, sharing, targeted advertising, or profiling;
- limit certain uses or disclosures of sensitive personal information;
- withdraw consent where processing is based on consent;
- appeal the denial of a request where applicable; and
- exercise privacy rights without unlawful discrimination.
These rights are subject to definitions, exceptions, and verification requirements under applicable law. A right listed here may not apply in every circumstance.
To submit a privacy request, contact us at sales@frostysdyno.com. Please describe the request and provide information reasonably necessary for us to identify relevant records and verify the request. Do not send sensitive verification documents through ordinary email unless instructed to use a secure method.
An authorized agent may submit a request where applicable law permits. We may request proof of the agent's authority and, where permitted, verify the request directly with you.
You may opt out of marketing email by using the unsubscribe link in the message. You may still receive non-marketing communications about a request or service.
8. Data Retention
We retain information for as long as reasonably necessary for the purpose for which it was collected and for legitimate operational, security, recordkeeping, legal, and dispute-resolution needs. Retention depends on the type of information, the nature of the relationship, applicable legal requirements, and the need to establish or defend legal claims.
9. Data Security
We use reasonable administrative, technical, and organizational safeguards designed to protect information within our control. No Website, network, storage system, or Internet transmission can be guaranteed to be completely secure.
10. Sensitive Information
The Website is not designed to collect highly sensitive information through general forms. Please do not submit Social Security numbers, government identification numbers, full financial-account or payment-card details, account passwords, medical records, biometric data, or precise location information unless the Website specifically requests the information through an appropriate process.
If the nature of your request requires sensitive information, contact us to ask about an appropriate communication method.
11. Children's Privacy
The Website is intended for a general audience and is not directed to children under 13. We do not knowingly collect personal information online from children under 13. If you believe a child under 13 has provided personal information through the Website, contact us so we can review and address the matter.
This statement does not replace any additional notice or consent required if a Website is directed to children, knowingly collects information from children, or is subject to a law providing additional protections to minors.
12. Third-Party Websites and Services
Third-party websites and services accessible through the Website maintain their own privacy practices. This Policy does not govern information a third party collects independently from you. Review the third party's privacy notice before providing information.
13. Changes to This Privacy Policy
We may update this Policy to reflect changes in our practices, technology, or legal obligations. The current version will be posted here with a revised Last Updated date. If required by law, we will provide additional notice or obtain consent for a material change.
